Trademarks, logos and other distinctive signs of any kind appearing on the site belong to their respective owners. The use of trademarks, logos and other distinctive signs—including their reproduction on other websites—by unauthorized third parties is prohibited. The contents of the site (texts, graphics, images and animations) are protected by copyright; therefore, among other things, reproducing images and publishing them in any form without the written authorization of FANATICS ITALY is prohibited.

The contract may be concluded in Italian and English.
Every purchase through the Site is governed by the following terms.
Art. 1 – DEFINITIONS
1.1. “Site”: the website store.atalanta.it, dedicated to the sale of the official merchandising of Atalanta Bergamasca Calcio S.p.A.
1.2. “Customer”: the party (natural or legal person) who makes a purchase on the Site, accepting these general terms of sale.
1.3. “FANATICS ITALY”: FANATICS ITALY S.R.L., Via Magistretti 10, 20128 Milan, registered with the Milan Chamber of Commerce no. 359848 – Tax/VAT no. 11670080156. FANATICS ITALY is the official licensee of Atalanta Bergamasca Calcio S.p.A.
1.4. “Order”: the request form for goods on sale, completed by the Customer via the Site.
1.5. “Products”: the goods offered for sale on the Site under these general terms of sale.
1.6. “Customized Products”: goods customized at the Customer’s specific request/instructions.
1.7. “Price”: the consideration due for the Products.
1.8. “Contract”: the distance contract for the sale of Products under these general terms of sale.
1.9. “Parties”: FANATICS ITALY and the Customer.
1.10. “Consumer”: a natural person acting for purposes outside their business, commercial, craft or professional activity.
Art. 2 – TECHNICAL PROCEDURE FOR CONCLUSION OF THE CONTRACT
2.1. Products are offered for sale under the terms and conditions set out in the Contract published on the Site at the time of the Order.
2.2. To make a purchase, the Customer must:
I) select the Product and click “add to cart”: a summary of the main features of the Product and the total Price due will appear, including shipping costs (excluding any customs duties, where due) and taxes;
II) click “proceed to checkout” and complete the Order, indicating the delivery address, any preferred shipping method (where applicable) and the payment method; before proceeding, the Customer must check the accuracy of the data and is responsible for their truthfulness;
III) read and accept these general terms of sale and the Privacy Notice by ticking the relevant box;
IV) click “purchase/CONFIRM AND PAY”: the button indicates, as required by law, that placing the Order entails an obligation to pay for the Products.
2.3. The Customer will receive an Order confirmation indicating the type of Products ordered, the price of each, delivery charges, the chosen payment method, and notice of the right of withdrawal (Art. 8).
2.4. The Contract is deemed concluded and binding when FANATICS ITALY sends the Order confirmation to the Customer’s email address.
2.5. The Contract is archived; the Customer may view it by accessing their personal area or by contacting Customer Care.
2.6. The creation and supply of Customized Products is subject to a specific request according to the instructions on the Site. For such Products advance payment is required and the right of withdrawal from the purchase Contract is excluded.
2.7. In addition to Italian, the Contract may be concluded in English.
Art. 3 – DELIVERY TIMES AND METHODS
3.1. Delivery is arranged by express courier to the address indicated by the Customer in the Order.
3.2. Indicative delivery times: 24–48 hours for Italy; 48–72 hours for Europe; 3 or more working days for non-European countries, after 1 (one) working day from receipt of the Order by FANATICS ITALY. In any case, delivery will take place no later than 30 days from conclusion of the Contract.
3.3. If delivery does not occur within the agreed term or within 30 days, the Customer shall invite FANATICS ITALY to deliver within a reasonable additional period; if that additional period expires without delivery, the Customer may terminate the Contract. The additional period is not required where: (a) FANATICS ITALY has refused delivery; (b) the agreed term must be considered essential; (c) the Customer informed FANATICS ITALY before conclusion that delivery by/on a specific date is essential. In such cases, the Customer may terminate immediately, without prejudice to damages, and FANATICS ITALY shall refund without undue delay all sums paid.
3.4. Subsequent unavailability: if one or more Products are no longer available when the Order is received, FANATICS ITALY will promptly notify the Customer by email. The Order may be cancelled in full (with full refund) or partially accepted limited to available Products (the Customer pays only for those available).
3.5. Customer representations and resale ban: by placing an Order, the Customer represents that the Products ordered are lawful to possess and use at the destination and that they will be possessed or used lawfully in compliance with all applicable laws (including copyright). The Customer also represents that they are entitled to use the selected payment method. Ordering for the purpose of resale is prohibited: purchases are for personal, non-commercial use.
Art. 4 – REGISTRATION
4.1. No prior registration is required. The Customer may register (free of charge) or be automatically registered upon the first Order, receiving a password that can be changed via the link in the confirmation email. The Customer undertakes to provide correct, truthful and complete data (personal details, contacts, information useful for fulfillment).
4.2. The Customer keeps a copy of the purchase confirmation sent by store.atalanta.it to the email address provided.
Art. 5 – PRICE, PAYMENT AND INVOICING
5.1. Prices are in Euro (€) and include VAT applicable to the relevant product categories.
5.2. The total Price includes shipping costs, but excludes any customs duties and/or additional taxes necessary for import abroad. Customs clearance charges are borne exclusively by the recipient.
5.3. Payment of the price: at the time of the Order for advance payments (credit card, PayPal).
5.4. Any invoice request must be made at the time of the Order by ticking the relevant box at checkout.
Scalapay: receive your order immediately and pay in 3 installments. You acknowledge that the installments may be assigned to Incremento SPV S.r.l., to related parties and their assignees, and you authorize such assignment.
5.5. Orders placed by Customers in the United States (DDP / Sales Tax / 5 days)
5.5.1. Products will be shipped on a Delivered Duty Paid (DDP) basis; at checkout an amount may be added to cover estimated import duties into the USA.
5.5.2. For DDP service, the Customer agrees that FANATICS ITALY or its subcontractors will act on the Customer’s behalf in relation to importation, carrying out the customs formalities on behalf of the recipient.
5.5.3. Information required for customs formalities may be requested: the Customer must respond within 5 days of the request, failing which the Order may be cancelled.
5.5.4.Sales tax, if applicable, will be shown at checkout and in emails sent after the Order (after the goods subtotal).
Art. 6 – FORCE MAJEURE
6.1. If the Contract cannot be performed, in whole or in part, due to unavailability of goods or another force majeure event, FANATICS ITALY will notify the Customer by email within 30 days from transmission of the Order and will be released from all obligations, except to refund any amounts already paid.
Art. 7 – COPYRIGHT AND TRADEMARKS
7.1. The Contract does not grant the Customer any rights over trademarks, logos or other distinctive signs on the Site, nor over the related content.
Art. 8 – RIGHT OF WITHDRAWAL
8.1. Pursuant to Articles 52 et seq. of Legislative Decree 21/2014 (and the Consumer Code), the Consumer Customer has the right to withdraw without penalties and without giving reasons within 14 days from receipt of the goods (or, for Orders with multiple goods delivered separately, from possession of the last good).
8.2. To exercise the right of withdrawal before expiry of the term, the Customer informs FANATICS ITALY of the decision to withdraw:
a) by email to storecustomercare@atalanta.it (the model withdrawal form under Annex I, Part B of the Consumer Code, or any other explicit statement, is also valid).
8.3. The Customer returns the goods to FANATICS ITALY S.R.L. – Via Morelli 1, 20054 Segrate (MI), Italy, without undue delay and in any event within 14 days of the withdrawal notice (timely if dispatched before expiry).
8.4. Return costs are borne by the Customer, including any duties. The refund excludes transport costs (outbound and return) and any customs duties/taxes.
8.5. Goods must be returned in good condition, with original labels not removed, and packed carefully to protect original packaging from damage/writing/labels. The Consumer is liable for any decrease in value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.
8.6. If withdrawal is properly exercised, FANATICS ITALY will refund within 14 days from receipt of the withdrawal notice all payments received in relation to the Order concerned, using the same means of payment (unless otherwise agreed without extra costs). Under Art. 56(3) of the Consumer Code, FANATICS ITALY may withhold the refund until it has received the goods or until the Customer has provided proof of dispatch, whichever occurs first.
8.7. Withdrawal is available only to natural persons/Consumers; among others, resellers and companies are excluded.
8.8. Withdrawal is excluded (Art. 59 Consumer Code) for Customized Products, and for sealed goods not suitable for return for hygiene/health reasons and opened after delivery; also excluded for audio/video recordings opened after delivery.
8.9. No refunds for Customized Products (e.g., jerseys/shorts with player or personal names/numbers, patches, initials, except for faulty/damaged products); underwear, swimwear, face masks; match jerseys where a player changes number or transfers; discounted products (Outlet, special promotions).
Art. 9 – CUSTOMER RIGHTS IN CASE OF NON-CONFORMITY
9.1. If the Customer is a Consumer and detects a lack of conformity, the Customer is entitled, under Arts. 128 et seq. of the Consumer Code, to restoration of conformity by repair or replacement (at the Consumer’s choice under legal conditions), or to a proportional price reduction, or to termination of the Contract. Termination is not allowed where the lack of conformity is minor.
9.2. Following the notice, FANATICS ITALY will, within a reasonable time, arrange any collection at the Customer’s address and, after verifying the defect, make a partial or full refund of the Price. FANATICS ITALY may propose alternative remedies (e.g., a voucher equal to the amount paid), to be used by contacting Customer Service; if the Customer accepts, the proposed solution will be implemented (without prejudice to statutory rights).
Art. 10 – PRIVACY
10.1. The data provided by the Customer, necessary to perform the Contract, are processed in compliance with Regulation (EU) 2016/679 (GDPR) and Legislative Decree 196/2003. For further details, see the Privacy section of the Site.
Art. 11 – COMMUNICATIONS
11.1. All communications between the Parties must be made in writing and sent to the address of the other Party indicated, for FANATICS ITALY, in these terms, and, for the Customer, in the Order.
11.2. Communications sent by email to the other Party’s address so indicated are also validly made in writing.
Art. 12 – APPLICABLE LAW AND JURISDICTION
12.1. The Parties agree that the Contract is governed by Italian law and subject to Italian jurisdiction; application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.
12.2. Jurisdiction: (a) the court of the Customer-Consumer’s residence or domicile (if resident/domiciled in Italy); (b) in all other cases, the Court of Milan, exclusively.
12.3. The Customer may optionally use the European ODR platform provided by the European Commission: https://webgate.ec.europa.eu/odr.
